Regulations of Stay in Houseboat Modern 11

§1. General Conditions:

1. Houseboat Modern 11, located in Yacht Park Marina in Gdynia at ul. Rybickiego 4c, is rented to the Client on the basis of a reservation made through booking.com, Airbnb, or the website www.casamare.pl. The terms of use, rental period, and rental fee are specified therein.
2. The Client may use the Houseboat after paying the full rental amount.
3. On the day of collecting the keys or on the following day, the Client shall pay a cash security deposit of PLN 500 to the service staff, who will arrange the handover by telephone.
4. The deposit serves as security against minor technical damage to the Houseboat as well as losses in its equipment and shall be refunded if the stay is settled without damage on the last day of the stay. If there is technical damage or other losses in the equipment, the deposit shall be retained until the damage or deficiencies are repaired or replaced. After that time, copies of the invoices shall be provided to the Client and the deposit shall be settled accordingly.
5. The subject of the rental is the Houseboat, which may be used exclusively for tourism purposes.
   It shall be handed over on the first day of the rental from 4:00 PM in a condition suitable for the agreed use, technically operational, and with complete equipment.
6. Handover takes place by collecting the keys from the key box and familiarising oneself with the above regulations.
7. The Client undertakes to keep the Houseboat in the same condition throughout the rental period and to use it in accordance with its intended purpose.
8. The Houseboat shall be returned on the date specified in the agreement by 12:00 PM in the same condition as when handed over, i.e. technically operational, clean, and with complete equipment. Returning the Houseboat in a condition different from that in which it was received authorises the Lessor to reduce the deposit refund by a minimum of PLN 250.
   The Houseboat is covered by fire insurance.
9. In the event of a breakdown or other damage occurring during the rental period, the Client is obliged to immediately notify the Owner and prepare an “incident report” by email, which shall constitute the basis for the Client to seek compensation from the insurance company.
10. The Client bears financial responsibility for the Houseboat and its equipment during the rental period.
    The Owner shall not be responsible for theft occurring during the Client’s stay.
    If the damage qualifies for settlement under the insurance policy, the paid deposit shall be retained until compensation is obtained from the insurer. The deductible/excess shall be charged to the Client.
    The risk of damage to the Houseboat and its equipment shall be borne by the Client from the moment of handover until its return.
    This risk does not apply to damages that are covered (paid out) by the insurance company with which the Owner has concluded an insurance policy.
11. Without the Owner’s consent, the Client may not make any changes to the Houseboat’s equipment or structure.
12. The Client may not sublet the Houseboat.
13. No more persons may stay in the rented Houseboat than those declared at the time of booking. In the event that this number is exceeded, the deposit shall be forfeited.
14. Animals are not permitted in the Houseboat. The presence of animals shall result in forfeiture of the deposit.
15. The Client shall be responsible for any damage caused by animals.
16. The Client is obliged to exercise due care and observe health, safety, and fire protection regulations.
17. Smoking tobacco is strictly prohibited inside the Houseboat and on the terrace.
18. The use of corrosive or non-biodegradable chemicals is prohibited.
19. The Houseboat is cleaned by the Service Staff once a week.
    More frequent cleaning may be ordered from the Service Staff for an additional fee.
20. Any damage resulting from the consumption of alcohol or intoxicating substances shall be fully covered by the Client.
21. The Owner reserves the right to withdraw from the rental agreement without civil or legal consequences in the event of serious force majeure circumstances preventing fulfilment of the agreement, such as vandalism, theft, fire, storm, other dangerous weather conditions, or the consequences of such weather conditions.
22. Matters not regulated herein shall be governed by the provisions of the Polish Civil Code.
23. Any disputes shall be resolved by the District Court in Bydgoszcz.
